Privacy Policy

This policy explains what we collect when you use hauzisha.co.ke, why, who we share it with and what you can ask us to do about it. It describes what the site actually does rather than every practice the law permits.

1. Who controls your data

Hauzisha Platforms LTD, a company registered in Kenya with its office in Nairobi, is the data controller for personal data collected through this site. Write to us at support@hauzisha.co.ke.

We handle personal data in line with the Data Protection Act, 2019 and the regulations made under it.

2. What we collect when you browse

The site records how it is used so we can understand which properties and areas people are looking for. For each visitor we store:

  • a random identifier stored in a cookie, a generated number that is not linked to your name
  • how you arrived: the search engine, site or advert that referred you, and any campaign tags in the link
  • the pages and individual listings you viewed, in what order, how long you were actively reading, and how far down each page you scrolled
  • your device type, browser, operating system, browser language and time zone
  • your approximate location: country, and where available city and region
  • whether you tapped a call button, and from which page

3. What we do not collect

We do not store your IP address. The approximate location above is worked out at our hosting layer and only the resulting country, city or region is saved. The address itself is discarded and never reaches our database.

Browsing this site does not tell us your name, phone number or email address. We do not run advertising pixels, and we do not sell personal data to anybody. We do not knowingly collect data from children under 18.

4. What we collect when you contact us

When you call, email or send a message about a property, we hold what you tell us: your name, phone number or email, the property you asked about, your budget and requirements, and a record of our conversations. We use it to answer you, arrange viewings and progress a purchase.

If you have previously browsed the site on the same device, we may connect your enquiry to that browsing history so our team can see which properties you have already looked at.

5. Why we are allowed to hold it

Under the Data Protection Act, 2019 we rely on:

  • Legitimate interest, for the analytics described above, to run and improve the site and understand demand. This is limited to what a business needs to operate a property catalogue, and is balanced against your privacy.
  • Steps towards a contract, for handling your enquiry and the sale process that follows.
  • Consent, where we ask for it, for example before sending marketing messages. You can withdraw consent at any time.
  • Legal obligation, where we must keep records, for example for tax.

6. Who we share it with

Developers and property owners. When you enquire about a property, we pass the details needed to arrange a viewing and progress the sale to the developer or owner of that property. They handle your data under their own policies. We do not pass your details to developers whose properties you have not asked about.

Service providers who run the site for us. Our hosting provider, our database provider, our image delivery network, and Plausible Analytics, a privacy-focused analytics service that sets no cookies and collects no personal data. These providers process data on our instructions.

Some of these providers operate servers outside Kenya, so your data may be processed abroad. We only use providers who commit to appropriate safeguards for that transfer.

We will also disclose data where the law requires it, or to establish or defend a legal claim.

7. How long we keep it

Browsing analytics are kept for up to 24 months and then deleted. Enquiry and transaction records are kept for as long as we are dealing with you and then for up to 7 years, which is the period Kenyan tax and company records law requires. If you ask us to erase your data we will do so unless we are required to keep it.

8. Your rights

Under the Data Protection Act, 2019 you may ask us to:

  • tell you what personal data we hold about you, and give you a copy
  • correct data that is wrong or incomplete
  • delete your data, where we have no continuing reason to keep it
  • stop or restrict a particular use, including our use of analytics about you
  • provide your data in a portable form
  • stop sending you marketing, at any time

Email support@hauzisha.co.ke and we will respond within the statutory timeframe. If you are not satisfied with our answer, you may complain to the Office of the Data Protection Commissioner of Kenya.

9. Security

Data is held in access-controlled systems and transmitted over encrypted connections. Access is limited to the people who need it to do their job. No system is perfectly secure, but we design to hold as little as we can: not storing IP addresses is part of that.

10. Cookies

11. Changes

We will update this policy as the site changes. The date at the top shows when it last changed. Where a change materially affects your rights we will make that clear rather than rely on the date alone.
